Terms and Conditions
The following Terms and Conditions are also displayed at the event and a signature is required by the attendee prior entering the event.
RELEASE OF ALL LIABILITY AND AGREEMENT TO INDEMNIFY AND HOLD HARMLESS THIS FORM MUST BE SUBMITTED TO STAFF UPON ADMISSION TO THE EVENT
This agreement is required for anyone who wishes to attend an Albany Gamers event, and participate in the events held. We want to provide a safe and fun environment for everybody attending and for gamers of all ages.
I/we hereby waive, release and forever discharge Albany Gamers, itʼs organizers, sponsors, staff and volunteers, from any and all liability for any personal injuries or property damage that one or both of us may sustain as a result of, or during, our participation in any Albany Gamers events, including any personal injuries or property damage that I/we believe may have been sustained as a result of negligence, in whole or in part, of Albany Gamers. I/we further agree to indemnify Albany Gamers, its organizers, staff and volunteers from any and all claims of any nature whatsoever, including, but not limited to, personal injury and property damage or loss, by any third party or third parties, which they claim are caused, in whole or in part, as a result of any act(s) or conduct, whether unintentional, negligent, or intentionally, one or both of us, which my occur immediately prior to, during, or immediately following any Albany Gamers event.
I/we understand that Albany Gamers maintains a strict no alcohol and no drug policy and I/we agree not to bring with us to any Albany Gamers event or distribute at any Albany Gamers event any alcoholic beverages or any illegal drugs. Albany Gamers hopes that you will see these precautions as benefit rather than an inconvenience.
I/we also understand that Albany Gamers staff also has he right to remove any participant who does not conform to the rules or for any other reason at the discretion of the Albany Gamers staff.
I/we also understand and acknowledge that no surge protection is provided by Albany Gamers at this event. I/we have been urged by Albany Gamers to provide suitable electrical surge protection for all equipment utilized by us at this session. By affixing our signatures hereto, I/we agree to assume the risk that our computer, monitor, software or other equipment may be damaged or destroyed by power surges or other types of electrical activity.
I/we understand that our machine(s) and property are our personal responsibility and liability and agree to indemnify and hold harmless Albany Gamers, its organizers, volunteers, and staff from any claims arising out of, in whole or in part, our use in any way of our computers, monitor, or other computer related equipment during any Albany Gamers event.
Albany Gamers does not, under any set of circumstances, condone any type of illegal activity whatsoever, including but not limited to the copy of illegal software, MP3ʼs or distribution of pornographic material to minors, however, Albany Gamers cannot and will not police machines or network traffic looking for such files. Each individual is solely responsible for the software/files and copyright laws associated with items that are located on their machine. In addition, Albany Gamers has a firm policy against viewing pornographic material at our events. Please be aware that making pornographic material viewable and or accessible to minors is illegal and will not be tolerated.
By executing this waiver, release, agreement to indemnify and hold harmless, I/we acknowledge that I/we understand and agree to accept each of statements, waivers, released and agreements contained in this document and by our affixing our signatures hereto affirm that I/we will abide by these policies.
Guidelines of Participation
Participants WILL conduct themselves in a professional and sportsmanlike manner.
Participants will be available on time (as indicated in the schedule at the event).
Participants must be ready to play at the start of their match.
Failure to follow these guidelines will result in immediate disqualification
Cheating
Cheating will NOT be tolerated. Cheating is punishable by immediate disqualification from the Tournament and removal from the Event. An example of this would be hacking the server in someway to give you an unfair advantage in game. Refunds will not be given.
Violence
Acts of violence will NOT be tolerated. Violence will be deemed immediate disqualification from the Event and removal from the Premises. Violence is defined as physical force employed so as to violate damage or abuse (that can include behavior or actions.) Albany Gamers Administrators/Sponsors has all rights on what is considered a Violent Act or not.
Staff
Albany Gamers officials along with Sponsors execute all facets of the LAN and Tournament. Albany Gamers Administrators/Sponsors reserve the right to require any Participant to replay any match for any reason, at their sole discretion and to disqualify any participant who fails to follow the Official Rules, who makes any misrepresentation relative to the Tournament, who tamper with the entry process or the operation of the Tournament or Web Site, who acts in violation of the Official Rules, who acts in an unsportsmanlike or disruptive manner or who acts with intent to annoy, abuse, threaten or harass any other person(s). To ensure that players have played according to the Official Rules, Tournament Officials will review ALL game play during the Tournament. Decisions by Tournament officials are FINAL.
Limitation of Liability
Sponsors and/or Albany Gamers Administrators are not responsible for any inaccurate information, whether caused by the Official Web Site or by the Web Site users or by any of the equipment or programming associated with or utilized in the event or the Tournament or by any technical or human error which may occur in the processing of Tournament results. Albany Gamers Administrators/Sponsors assume NO liability for any injury, loss, material accessible, or damage of any kind arising from or in connection with any person’s participation in the Event or Tournament, including without limitation, participation in any real life activity, or injury, loss or damage sustained from use of any prize won. If for any reason the Event or the Tournament is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Albany Gamers Administrator’s/Sponsors which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Event or the Tournament, Albany Gamers Administrator’s/Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend the Event and the Tournament. By participating in the Tournament, each Participant agrees to be bound by the Official Rules. Albany Gamers ADMINISTRATORS/SPONSORS SHALL NOT BE LIABLE FOR PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, ANY MATERIAL WHETHER IT BE EXPLICIT OR OBSCENE, WHETHER OR NOT SUCH DAMAGES COULD HAVE BEEN FORESEEN AND WHETHER OR NOT SPONSORS OR ANY SPONSOR OR ADMINISTRATOR RECEIVED NOTICE THEREOF.
Indemnity
Registrant does hereby agree to indemnify, defend and hold harmless each Albany Gamers Administrator/Sponsor and each Sponsor’s directors, officers, employees, agents and representatives from and against all losses, lawsuits, causes of action, claims and damages which arise from the acts or omissions of Registrant in connection with the Event or the Tournament.
